ARTICLE 1 - PRICES

1.1 - The prices of our products are indicated in euros, inclusive of all taxes but excluding shipping and handling costs.

1.2 - In the event of an order to a country other than metropolitan France, you are the importer of the product(s) concerned. For all products shipped outside the European Union and French overseas departments and territories, the price will automatically be calculated exclusive of tax on the invoice. Customs duties or other local taxes, import duties or state taxes may be payable. REAL AND ROOTS.COM is not responsible for these charges. They will be at your expense and are your sole responsibility, both in terms of declarations and payments to the authorities and/or competent bodies in your country. We advise you to contact your local authorities for further information.

1.3 - All orders, whatever their origin, are payable in Euros.

1.4 - REAL AND ROOTS.COM reserves the right to modify its prices at any time, but the products will be invoiced on the basis of the prices in force at the time the order is registered, subject to availability.

1.5 - Products remain the property of REAL AND ROOTS.COM until full payment has been received.

ARTICLE 2 - ORDERING

Contractual information is presented in French. REAL AND ROOTS.COM reserves the right to cancel or refuse any order from a customer with whom there is a dispute relating to the payment of a previous order.

ARTICLE 3 - VALIDATION

You declare that you have read and accepted these General Terms and Conditions of Sale before placing your order. Confirmation of your order therefore implies acceptance of these Terms and Conditions.

In the absence of proof to the contrary, the data recorded by patate-records.com constitutes proof of all transactions between patate-records.net and its customers.

ARTICLE 4 - AVAILABILITY

Our product offers and prices are valid as long as they are visible on the site, while stocks last.

For products not stocked in our warehouses, our offers are subject to availability from our suppliers.

In this context, information on the availability of products is provided when you place your order. As this information comes directly from our suppliers, errors or modifications may exceptionally occur. In the event of product unavailability after you have placed your order:

• For payment by check, in case of unavailability of all or part of the order, the refund will be made at the option of REAL AND ROOTS.COM by credit to the customer's bank account or by check no later than thirty days after payment of sums paid by the customer.
• For payment by credit card, in the event of unavailability of all or part of the order, reimbursement will be made by crediting the customer's bank account within thirty days of payment of the sums paid by the customer.

ARTICLE 5 - DELIVERY

Products are delivered to the delivery address you provided during the order process. The average order processing time is 48 hours from payment of the order. The delivery time depends on the carriers, it being understood that the carriers guarantee in principle a delivery in 48H.

In the event of items being delivered on different dates due to their availability, the delivery period is based on the longest period. REAL AND ROOTS.COM reserves the right to split deliveries. Shipping and handling charges will only be invoiced for a single shipment. REAL AND ROOTS.COM cannot be held responsible for the consequences of late delivery. Any order not dispatched within 30 days of the order being placed will be cancelled unless otherwise stipulated and announced in the sales offer.

If you are late, we will send you an e-mail.

In the case of payment by credit or debit card, the times indicated are average times and correspond to processing and delivery times for products destined for metropolitan France and Monaco. In the case of split deliveries, only the products shipped will be debited.

In the event of payment by cheque, the order will be processed on receipt of the cheque. Consequently, the lead times applicable in this case are those applicable on the day the cheque is received, and may therefore be different from those applicable on the day the order is placed.

ARTICLE 6 - PAYMENT

The payment of your purchases is carried out :

• by credit card: Visa, MasterCard, American Express, other Cartes Bleues, PayPal
• or by cheque
• by postal order

If payment is made by cheque, it must be issued by a bank domiciled in mainland France or Monaco.

The check is cashed upon receipt.

Cheques should be sent to Intertrade, 144 rue de Clermont 60000 Beauvais.

ARTICLE 7: SECURITY

Not only have we adopted the SSL encryption process, but we have also strengthened all our scrambling and encryption procedures to protect all sensitive payment data as effectively as possible.

ARTICLE 8 - SATISFIED OR REIMBURSED

You have 15 days from the date of receipt to return the product if it does not suit you.

You will then be responsible for shipping and return costs. Only the price of the product(s) purchased will be refunded.

Returns must be made to Intertrade 144 rue de Clermont 60000 Beauvais - France in their original packaging, complete (accessories, instructions, etc.) and in good condition.

Items returned incomplete, damaged or soiled by the customer will not be accepted.

ARTICLE 9 - PRODUCT CONFORMITY

We undertake to refund or exchange any products that do not correspond to your order. In this case, we would be grateful if you would make a detailed written statement and return the product(s) to us. REAL AND ROOTS.COM will exchange or refund the product(s).

Shipping costs will be reimbursed on the basis of the invoiced rate and return shipping costs will be reimbursed. In any event, you benefit from the provisions of the legal guarantee, in particular those relating to the guarantee against hidden defects.

ARTICLE 10 - REIMBURSEMENT

Refunds of products in the cases referred to in articles 8 and 9 will be made within 30 days or less of receipt of the products by us.

The refund will be made at the option of REAL AND ROOTS.COM by crediting your bank account or by check sent in the name of the customer who placed the order and billing address. No cash on delivery will be accepted for any reason whatsoever.

ARTICLE 12 - LIABILITY

The products offered comply with current French legislation. Real and Roots cannot be held responsible in the event of non-compliance with the legislation of the country to which the products are delivered (e.g. in the event of a ban on a title, etc.). It is your responsibility to check with local authorities about the possibility of importing or using the products or services you intend to order.

The photographs reproduced and illustrating the products presented are given for information only. Real and Roots shall not be held liable for non-performance of the contract entered into in the event of force majeure, disruption or total or partial strike, in particular of postal services and means of transport and/or communications, flood or fire.

In the case of professional purchases, Real and Roots shall not be held liable for any indirect damage, operating loss, loss of profit, loss of opportunity, damages or expenses.

ARTICLE 13 - APPLICABLE LAW - DISPUTES

This contract is governed by French law.

The language of this contract is French.

In the event of a dispute, the French courts shall have exclusive jurisdiction.
